Bombay HC dismisses UCNI Trust's plea... ( Prem Masih of CNI tried to represent UCNI but denied by court)

Vaibhav Ganjapure,TNN | Jan 12, 2013, NAGPUR: Single bench of Justice ML Tahaliyani at the Bombay high court's bench at Nagpur dismissed a petition filed by United Church of Northern India Trust Association, through the association's managing director, Prem Masih.

The petition sought dismissal of proceedings instituted by Judicial Magistrate First Class (JMFC), Nagpur, for assaults, threats and trespass by the petitioner on the church premises of AHM (1840) Nagpur church UCNI at Kingsway, Nagpur.

These allegations were leveled by Prashant Yenprediwar on whose complaint, the JMFC ordered for proceedings against the petitioner.

Though the petitioner questioned the accuracy of the lower court's decision and also submitted an alibi, the court accepted the respondent's contention.

They had argued that firstly the case involves question of evidence, secondly, the petition is filed after the end of limitation period and thirdly in lieu of alternate remedy, it is not maintainable.

Salim I Khan appeared on behalf of petitioner; additional government pleader Sanjay Doifode appeared for state and Prashant Kaole appeared for complainant Yenprediwar.
